HUNGRY JACK’S x PISTACHIO PAPI COMPETITION – 2 SEPTEMBER 2026
Information on how to enter forms part of these terms of entry. Entry into the Promotion is deemed acceptance of these terms and conditions.
The Promoter is Pistachio Papi, VIC 3008 (Anecdote Official PTY LTD T/AS Pistachio Papi, 10 English Street, Essendon Fields). Prize provider is: Hungry Jack's Pty Ltd (ABN 25 008 747 073) (Hungry Jack’s). Hungry Jack's is a prize provider only and is not responsible for the administration, conduct, judging or operation of the Promotion.
Promotion commences on 2 September 2026 at 6pm AEST and ends on 7 September 2026 at 6:00pm AEST (Promotion Period). No entries will be accepted outside the Promotion Period.
Exclusions of Entry
Employees (and their immediate family members) of the Promoter, Hungry Jack’s and their franchisees and agencies associated with this Promotion are not eligible to enter. “Immediate family member” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
How to Enter
Entry is open to all residents of Australia aged 16 years and over.
For the purposes of these terms and conditions, an “eligible entrant” is a person who has complied with these terms and conditions.
To enter, eligible entrants must during the Promotion Period:
- have an Instagram account and ensure their Instagram profile is public;
- follow @pistachiopapiofficial and @hungryjacksau on Instagram;
- comment on the Promotion post on the @pistachiopapiofficial Instagram account, in 15 words or less, explaining why they deserve a Hungry Jack’s x Pistachio Papi Prize Pack.
By completing the steps above the entrant will receive one (1) entry into the Promotion.
Invalid entries (including comments exceeding 15 words, or from entrants not following both @pistachiopapiofficial and @hungryjacksau) will be excluded from the Promotion. Eligible entrants may enter multiple times, provided each entry is a separate, original comment submitted in accordance with the entry instructions above. Each entrant is eligible to win a maximum of one (1) Prize Pack, regardless of the number of entries submitted.
No entry fee is charged by the Promoter to enter the Promotion. There is no additional cost to enter the Promotion other than any cost paid by the entrant to access the internet or Instagram via their internet service provider.
By entering the Promotion, eligible entrants:
(a) agree to participate in and co-operate as required with all reasonable marketing activities relating to the Promotion and the Prize Pack;
(b) consent to their name and Instagram handle being made publicly available on the Promoter’s and Hungry Jack’s social media pages;
(c) consent to their entry being used by the Promoter and Hungry Jack’s in accordance with these terms and conditions (and by Meta for promotion purposes in accordance with Meta’s terms of use); and
(d) must reside in Australia to be eligible to win.
Prizes and judging
This is a game of skill and creativity, not a game of chance. Winners are determined solely on the creativity and originality of their comment entry, judged in accordance with the process set out below — no random or chance-based element determines the outcome. Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission by the entrant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.
Judging will take place at 6:00pm AEST on Sunday 6 September 2026. The Pistachio Papi team will review all valid entries received during the Promotion Period and select the ten (10) entries they consider most creative, in the Promoter’s sole discretion. All judging decisions are made solely by the Promoter. Hungry Jack's has no involvement in the judging process or selection of winners.
The Promoter will select 10 winners. Each winner will receive one (1) Hungry Jack’s x Pistachio Papi Prize Pack, comprising:
- HJ’s x Papi Apron — approx. RRP $16
- HJ’s x Papi Spoon & Sleeve — approx. RRP $11
- HJ’s x Papi Storm & Shake Token — approx. RRP $14.90
- Pistachio Papi Jar — approx. RRP $12
with a total approximate value of $55 per Prize Pack. Total approximate prize pool value across all 10 Prize Packs is $550. The Prize Pack is subject to the following conditions:
(a) Prize Packs will be posted to winners by the Promoter to the postal address provided by the winner. Winners must provide a valid Australian postal address within 3 days of notification in order to receive their Prize Pack. The Promoter is solely responsible for prize fulfilment, winner communications, postage, delivery and handling of any prize-related enquiries.
The Prize Pack (or any portion of it) cannot be exchanged or redeemed for cash. If a Prize Pack (or portion of it) is unavailable for any reason, the Promoter reserves the right to substitute the Prize Pack (or that portion) for a prize of equal or greater value, subject to state regulation.
Prize judging and winner notification
Judging will take place at 6:00pm AEST on Monday 7 September 2026 by the Promoter, via Instagram.
The 10 winners will be notified by direct message to their Instagram account (Direct Message) within 1 business day of judging, and will be announced via the Promoter’s (Pistachio Papi’s) authorised Instagram account.
Prizes must be claimed by 6:00pm AEST on 9th September 2026 by responding to the Direct Message and following any instructions provided, including supplying a valid postal address.
In the event of any unclaimed prize, or if a winner does not submit the requested information by the claim deadline, that prize will be forfeited and may be redrawn by the Promoter, in its sole discretion, from the remaining eligible entries. Any redrawn winner will be notified by Direct Message within one (1) day of the redraw.
If there is a dispute as to the identity of an entrant or winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or winner.
The Promoter’s decision is final, and the Promoter will not enter into correspondence regarding the Promotion result or the enforcement and interpretation of these terms and conditions (including any disqualification).
Other
The Promoter reserves the right, at any time, and in its sole discretion to (a) request entrants to provide proof of identity and/or proof of valid entry; or (b) disqualify any entrant who the Promoter has reason to believe has breached any of these conditions or engaged in any unlawful or other improper conduct, or any conduct calculated to jeopardise the fair and proper conduct of the Promotion.
If for any reason this Promotion is not capable of running as planned, including but not limited to tampering, weather event, earthquake, terrorism, unauthorised intervention, fraud, any technical difficulties or equipment malfunction, or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right, in its sole discretion, to take any action that may be available, and to cancel, terminate, modify or suspend the Promotion, subject to state regulation.
The Promoter makes no representations or warranties as to the quality, suitability or merchantability of any goods or services offered as part of the Promotion. To the extent permitted by law, the Promoter is not liable for any loss (including indirect and consequential loss) suffered to person or property by reason of any act or omission (including deliberate or negligent acts or omissions) by the Promoter, or their employees or agents, in connection with the arrangement for the supply, or the supply, of goods or services by any person to the prize winners. This clause does not affect any rights a consumer may have which are unable to be excluded under Australian law. To the fullest extent permitted by law, any liability of the Promoter or its employees or agents for breach of any such rights is limited to the payment of the costs of having the prize supplied again. To the extent permitted by law, Hungry Jack's is not liable for and accepts no responsibility for the administration, conduct, judging, winner selection, fulfilment or operation of the Promotion.
Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Entry and continued participation in the Promotion is dependent on the entrant following and acting in accordance with the Instagram Terms of Use (http://instagram.com/legal/terms/). This Promotion adheres to the terms and conditions set out in the Instagram promotion guidelines, which can be found at: http://help.instagram.com/179379842258600. Any questions or comments regarding the Promotion must be directed to the Promoter, not to Instagram. The entrant releases Instagram and its associated companies from all liabilities arising in respect of the Promotion. Entrants acknowledge that the Promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram.
The value of the Prize Pool is accurate and based upon the recommended retail value of the prizes (exclusive of GST) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the Prize Pool after that date.
Privacy
The Promoter collects the entrant’s personal information for the purpose of conducting and promoting this Promotion (including but not limited to determining and notifying winners) and may disclose the entrant’s personal information to third parties, including its contractors and agents, prize suppliers and service providers, to assist in conducting this Promotion. If the entrant does not provide their personal information as requested, they may be ineligible to enter or claim a prize in the Promotion.
By entering the Promotion, unless otherwise advised, each entrant also agrees that the Promoter may use personal information collected to conduct the Promotion, in any media, for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages. The Promoter is bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 (Cth). The Promoter will hold entrants’ personal information in a secure manner in accordance with the Promoter’s Privacy Policy (a copy of which can be found at https://pistachiopapi.com.au/policies/privacy-policy). The Promoter’s privacy policy contains information about how the entrant may access, update and seek correction of the personal information the Promoter holds about them, and how the entrant may complain about any potential breach by the Promoter of the Australian Privacy Principles or any other Australian privacy laws, and how such complaints will be dealt with.
Hungry Jack's does not collect, receive, store, access or use entrants' personal information for the purposes of this Promotion.
